Terms of Service

By creating an account or using the Friends with Habits mobile app ("the Service"), you agree to these Terms of Service. The Service is operated by Therr Inc. ("we", "us"). If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. The Service is not designed for or directed at users under 13.

Your account

• You are responsible for safeguarding your account credentials.
• You must provide accurate registration information and keep it current.
• You are responsible for all activity under your account.
• Notify us promptly if you believe your account has been compromised.

How the Service works

Friends with Habits is an accountability-based habit tracker. You create "pacts" — commitments to a daily habit — and invite at least one friend to be your accountability partner. Both partners check in daily and see each other's progress.

You acknowledge:

• Pacts require at least one partner. The Service is intentionally designed so habits cannot be tracked entirely solo.
• Your check-ins, including any photos and notes you attach, are visible to your pact partners.
• Streaks, completion rates, and partner activity are core to the Service and are not optional features.

User content

You retain ownership of any content you submit to the Service (check-in notes, check-in photos, profile information). By submitting content, you grant Therr Inc. a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display that content solely for the purpose of operating and improving the Service.

You agree not to submit content that:

• Is unlawful, defamatory, harassing, or abusive.
• Infringes anyone's intellectual property or privacy rights.
• Contains malware, spam, or attempts to compromise the Service.
• Sexualizes minors in any way.
• Promotes self-harm, violence, or illegal activity.

We reserve the right to remove any content that violates these terms and to suspend or terminate accounts of users who do so repeatedly.

Acceptable use

• Don't attempt to reverse-engineer, scrape, or interfere with the Service.
• Don't impersonate another person or misrepresent your affiliation.
• Don't use the Service to send unsolicited messages or spam other users.
• Don't try to access another user's account or data.

Subscription and payments

The Service offers a free tier (one active pact at a time) and a paid premium tier (additional features). When the premium tier launches, subscription terms — including price, billing cycle, and refund policy — will be presented at the time of purchase. Subscriptions auto-renew until cancelled in your device's app store settings.

Termination

You may delete your account at any time via Settings. We may suspend or terminate your account if you violate these terms or engage in conduct we reasonably believe is harmful to the Service or other users. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will survive.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Therr Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

The Service is a habit-tracking tool. It is not a substitute for medical, mental-health, fitness, or professional advice. Consult a qualified professional for matters relating to your health or wellbeing.

Limitation of liability

To the fullest extent permitted by law, Therr Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim arising from your use of the Service is limited to the greater of the amount you paid us in the 12 months preceding the claim or $50.

Indemnification

You agree to indemnify and hold harmless Therr Inc. from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these terms.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated in-app and the "Effective" date above will be updated. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.

Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. Any dispute arising under these terms will be resolved in the state or federal courts located in Travis County, Texas.

Friends with Habits is a product of Therr Inc. Your account is shared with the Therr family of apps; use of other Therr-family apps is governed by their respective terms, available at www.therr.com.
